Optus “Australian Open Tennis” Game of Skill Promotion Conditions of Entry

  1. Information on how to enter and prizes forms part of these conditions of entry.
  2. Entry is limited to Optus Pre-Paid, Optus Mobile Digital customers. Employees and their immediate families of the Promoter and its agencies associated with this promotion are ineligible to enter. Optus Service Provider, MobileSat, Optus Corporate and Optus CDMA customers are also ineligible to enter.
  3. The promotion commences at 12:01 am AEST on 08/01/2007 and closes 11:59 pm AEST on 08/02/2007.
  4. The winning entries as determined by the judges will be decided 3:00 pm AEST 20/02/2007. at 101 Miller Street, North Sydney, NSW 2060. The judges’ decision is final and no correspondence will be entered into. This is a game of skill and chance plays no part in determining the winner. The winners will be contacted by mail and via SMS and/or phone. Entries will be judged and the most original response will be selected as the winners and the names of winners of prizes valued at over $100 will be published in The Australian on 27/02/2007.
  5. The Promoter, in its absolute discretion, reserves the right to verify the validity of all entries and to disqualify any entrant who tampers with the entry process, including but not limited to, techniques designed to avoid payment of WAP or GPRS costs. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  6. No responsibility is accepted for late, lost or misdirected entries.
  7. All entries are deemed to be received at the time of receipt of the SMS and not at the time of transmission. Any costs associated with entering this promotion is the entrants responsibility.
  8. To qualify for entry, Entrants must send Optus an SMS answering the question in under 160 characters : ‘What would give you the competitive edge against the world №1 seed Roger Federer?’ SMS answers to 19 77 88 88 (SMS data charges $0.55 apply). Winners will be judged based on the most original response. There is no limitation on the number of entries per person.
  9. The first valid entries judged as the most original responses will win the major prize pack valued at $1410 which consists of tennis racket signed by Roger Federer Tony Roach and John Newcombe, two sets of professional Wilson tennis balls, Optus tennis cap, Optus Australian Davis cup team signed t-shirt, Optus Australian Federation cup team signed poster and a Nokia N73 handset. The entries judged as the next 2 most original responses valid will win the following runner up prize pack valued at $140 which includes a set of Wilson tennis balls and Federation Cup signed poster.
  10. Total prize pool value is $1690. Prizes are not transferable or exchangeable and cannot be taken as cash. The Promoter accepts no responsibility for any variation in the prize values.
  11. The Promoter will not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained as a result of taking the prize, except for any liability which cannot be excluded by law.
  12. If for any reason this competition is not capable of running as planned due to any reason (including but not limited to) technical failures unauthorised intervention, fraud or any other causes beyond the control of the promoter which corrupts or affect the administrator security fairness, integrity or proper conduct of the competition, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the process and subject to any written directions given by the various Lottery Departments, to cancel, terminate, modify or suspend the competition.
  13. All entries become the property of the Promoter. The Promoter collects Entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the Entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each Entrant consents to the information they submit with their entry being entered into a database and the Promoter and its related bodies corporate may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant including sending the Entrant electronic messages. All personal details of the Entrant provided by entering the promotion will be stored at the office of the Promoter.
